I think you should either disqualify or lower the score if the app requires some sort of registration, needs to be online at least once for it to function (and thus collect user data), a double all the negatives if settings aren’t stored on the headphones directly (meaning the app is required again). Sony, for instance, advertises a set of features, most of which require the app which requires to agree to number of things and an account for others to use the features that were allegedly sold to you already. \

I don’t know any other example, I never get the apps because they’re often kind of junky but I was curious and got to Sony one which only served to reinforce my belief that Sony is not such a good brand anymore, that sucked.

Also, though not related to apps, could you update, or add to your future reviews if headphones can be used while being charged? Neckband-style in-ears specially, since they have a charging port like regular on-, and/or over-ears.
